Summary
Conflict of jurisdiction based on the application of Brussels I Regulation provisions. Key facts: Commercial matters case. The matter of the case is an unfair competition dispute between a Spanish company and two German companies. The companies disagree as to the place where the legal proceedings should take place. The damages were caused in Spain. Court decision: the court estimates that Spanish courts are competent to decide on the case according to art. 5.3 of Brussels I Regulation (place where the harmful event occurred). The court applies the provisions on special jurisdiction of Brussels I Regulation according to which a person domiciled in a Member State may, in another Member State, be sued in matters relating to tort, delict or quasi-delict, in the courts for the place where the harmful event occurred or may occur.
