Summary
Application of Brussels I and Brussels II a Regulations provisions to the enforcement of a foreign court decision in Spain. The matter of the case is the enforcement of an Italian court judgement in Spain. The plaintiff appeals and alleges absence of notification. Court decision: the court estimates that the Italian court decision must be enforced in Spain. The exception contained in art. 34. 2 cannot be alleged because it was proved that the plaintiff had the chance to stand before the Italian court in a prior hearing.
