Summary
Application of Brussels I Regulation provisions to the enforcement of a foreign court decision in Spain.
The matter of the case is the recognition and enforcement in Spain of an arbitral decision from France. The plaintiff alleges the existence of lis pendens (same proceedings initiated in Italy).
Court decision: the French arbitral decision is recognised by the court and must be enforced in Spain according to art. 2.2 d) of Brussels I Regulation (arbitral decisions are excluded from the scope of application of Brussels I Regulation: other proceedings on the same case initiated in other Member States are allowed).
