Summary
Application of Brussels I Regulation provisions to the enforcement of a foreign court decision in Spain. Key facts: appeal against the enforcement of a German court decision previously accepted by a Spanish court. Court decisión: the court decides that the foreign court decision fulfils the requirements of arts. 32, 34 and 41 and the Annex V of Brussels I Regulation. As a consequence, the German court decision must be recognised and enforced in Spain. The Spanish court cannot review the foreign court decision as to its substance (arts.36 and 45 of Brussels I Regulation).
