Summary
Conflict of jurisdiction based on the application of Brussels I Regulation provisions. The ,atter of the case is a conflict of jurisdiction between two first instance Spanish courts on the enforcement of a foreign court decision in Spain. Court decision: the court resolves the conflict of jurisdiction applying art. 39.2 of Brussels I Regulation. In order to decide, the court applies Brussels I Regulation provisions on the enforcement of a foreign court decisión given by another Member State which state that the local jurisdiction shall be determined by reference to the place of domicile of the party against whom enforcement is sought, or to the place of enforcement.
