Summary
Application of Brussels I Regulation provisions to the enforcement of a foreign court decision in Spain. The matter of the case is the recognition and enforcement of an Italian arbitral decision (title of nobility) in Spain. Court decision: the arbitral decision cannot be recognised and enforced in Spain. According to art. 1.2 d) of Brussels I, the Regulation is not applicable to the case (arbitral decision). The court cites CJEU´s case law in that sense. In addition, the arbitral decision is contrary to Spanish public policy (art. 34.1 of Brussels I Regulation) for it is only a declaratory judgement. Moreover, and following national law, only the King of Spain could decide on the recognition of a title of nobility.
