Summary
Application of Brussels I Regulation provisions to the recognition and enforcement of a foreign court decision in Spain. The matter of the case is the recognition of a foreign court decision in Spain and a claim for payment in the context of a commercial matters case. A British court determines the terms following which a debt must be paid between the parties. Court decision: the Spanish court cannot review the British judgment as to its substance as the plaintiff claims (art. 45.2 of Brussels I Regulation). In order to decide, the court makes an effective examination of the formal requirements of Brussels I Regulation for the enforcement of a foreign court decision delivered by another Member State.
