Summary
Application of Brussels I and Brussels II a Regulations provisions to the enforcement of a foreign court decision in Spain.
The matter of the case is the enforcement of a Belgian court decision in Spain.
Court decision: the court decides that the Belgian court decision must be automatically enforced in Spain according to art. 32 of Brussels I Regulation. The court can only control the fulfilment of the formal requirements of the foreign court decision, according to art. 41 of that Regulation.
The court makes an effective examination of the formal requirements of Brussels I Regulation for the enforcement of a foreign court decision delivered by another Member State.
